Producers May Be Eligible For Muti-year Crop Losses

The USDA Farm Service Agency (FSA) has announced that producers may be eligible for benefits under the 1998 Crop Loss Disaster Assistance Program (CLDAP) multi-year provision.

Eligibility for CDLAP benefits under the multi-year option required crop losses by a producer in at least 3 of the 5 years from 1994 through 1998. The multi-year benefit was based on a percentage of the total dollar amount the producer received and recorded by the producers ID number, for combing crop insurance indemnities, Noninsured Crop Loss Disaster Assistance Program (NAP), and ad hoc disaster assistance during the 5-year period.

Recent legislation revised the eligibility requirements for the multi-year benefit. Producers that would have qualified for the 1998 CLDAP multi-year benefit in the absence of legal restructuring of their farm operation, or that may have thw applicant previously received 1998 CLDAP benefits under the single year option, and the applicant is now eligible for a multi-year benefit, the applicant will received difference if the multi-year benefit is greater.

Eligible producers includ those that previously filed an application but did not meet eligibility requirements, now meet the eligility requirements, but did not previously submit an application, and received a payment for a single-year loss, did not initially qualify for multi-year benefits under the revised eligibility requirements. Producers who are not sure as to their revised eligibility are encouraged to file an application.

The applicant is responsible for completeing the request for program benefits on form CCC-540 MY. Information provided by the applicant must include the the producers name, address, and identification number, each entity or joint operation with the ID number listed by year used for qualification, the applicants share of each entity or joint and the amount of crop insurance indemnities received by each entity or joint operation.

The following supporting documentation must accompany each CCC-540 MY: 1) actual records of crop insurance indemnities by year specified: 2) applicable CCC-502 and related forms for each entity and joint operation used for qualification; 3) AD-1026 for each entity and joint operation used for qualification; 4) CCC-548 for the application and each entity used for qualification; 5) copies of 1998 CLDAP applications previously submitted by the applicant and the entities or joint operations used for qualification; and 6) records of 1998 CLDAP benefits previously approved for applicant and the entities or joint operations used for qualification.

Applications and supporting documentation must be sent to: USDA/Farm Service Agency, Room 3643-S, STOP 0517; 1400 Independence Ave. SW, Washington, DC 20250-0517 or by fax to 202-720-4941. Designate on the application package Multi-year Revised Eligibility Determination Request. Complete applications must be received at the above address by close of business on Sept. 14, 2001. Late and incomplete applications will be returned to the applicants with a denial notification.
